Terms and Conditions

These Terms and Conditions regulate the access and use of the Socialifyx™ platform, owned and operated by SCMT S.A. (hereinafter, "the Company"). Registration on the platform and use of its services implies full and unreserved acceptance of this instrument. If you do not agree with any of the points set forth here, you must refrain from using the platform and its associated services.

1. Purpose of the Service and Platform Description

Socialifyx™ is an advanced Software as a Service (SaaS) platform designed to boost team productivity through a state-of-the-art ecosystem of tools that enable:

  • Multi-format Generation and Creation: Automated creation of articles, hashtags, texts, images and videos using Artificial Intelligence for social media promotion.
  • Campaign Centralization: Strategic planning and content organization for multiple clients and brands from a single place.
  • Control and Approval Workflow: Advanced team workflow management through role administration, permissions, content validation and final approval before definitive publication.
  • Automated Publication Flow: Direct connection and scheduling of publications on specific dates and times for various social networks (Facebook, Instagram, LinkedIn, TikTok, YouTube, among others).
  • Metrics: Visualization of data and technical performance provided by the official APIs of linked platforms.

2. Technological Infrastructure, Content Generation and Security

The platform is built on a state-of-the-art architecture designed to guarantee a fluid, scalable and highly secure user experience:

  • Architecture and Development: Socialifyx™ is developed using cutting-edge technologies such as Next.js (App Router), TypeScript, Tailwind CSS and shadcn/ui.
  • Artificial Intelligence Engines: The platform integrates and orchestrates advanced models from OpenAI, Perplexity, Anthropic Claude, Google, Meta AI and Grok.
  • Backend and Secure Storage: The entire data ecosystem relies on Google Cloud and Firebase under high-security encryption protocols.
  • External Communications and Social Networks: Interconnection is carried out through official APIs subject to the Developer Policies of each platform. Access is managed via OAuth, storing only encrypted access tokens.

3. Platform Intellectual Property

Ownership: All software, source code, algorithms, interfaces, designs, trademarks and associated technology are the exclusive property of the Company. Total or partial reproduction, reverse engineering or scraping is expressly prohibited.

User Content: The User retains intellectual property over the content they generate. However, they grant the Company a technical, limited and non-exclusive license for the sole purpose of processing, storing and transmitting the information for the correct provision of the contracted service. This license is personal and non-transferable during the subscription period.

4. Service Level Agreement (SLA) and Technical Availability

The Company will make its best commercial and technical efforts to guarantee service availability, with an annual target of 99.9%, excluding scheduled maintenance.

The User acknowledges and accepts that operation depends on critical third-party infrastructures (Google Cloud, OpenAI, official APIs, etc.). Consequently, the Company assumes no responsibility for interruptions, delays or failures derived from said external providers or force majeure events.

5. Payments, Refunds and Cancellations

Payments are managed securely via FastSpring. No refunds apply on already consumed credits or ongoing subscription periods. The user can cancel their subscription at any time.

6. Disclaimer and Limitation of Liability

The Company shall not be liable for content generated by AI, being the User's responsibility to validate it before publication. Likewise, no responsibility is assumed for suspensions, blocks or deletion of accounts imposed by external platforms (Meta, LinkedIn, etc.).

The Company's total liability is limited to the amount paid by the User in the 3 months prior to the claim or USD 2,000, whichever is less.

7. Data Protection and Deletion Policy

The Company complies with Law No. 25.326 and the GDPR. Data is protected in encrypted form. The User may request the definitive deletion of their account by sending an email to soporte@socialifyx.com (deadline of 72 business hours).

8. Acceptable and Responsible Use Policy

The generation of illegal content, spam, identity theft or system abuse is prohibited. Any violation will allow the Company to terminate the service immediately.

9. Applicable Law and Jurisdiction

These Terms are governed by the laws of the Argentine Republic. The parties submit to the exclusive jurisdiction of the Ordinary Courts of the Ciudad Autónoma de Buenos Aires.

Notwithstanding the above, users may exercise the powers recognized by the personal data protection regulations of their jurisdiction (e.g. Law No. 25.326 or GDPR), as applicable.
